  1. The victim’s death must be due, in whole or in part, to the conduct of the defendant.
  2. The defendant must be shown to have been negligent or strictly liable for the death.
  3. The victim must be survived by a spouse, children, or parents.
  4. Damages must have resulted from the victim’s death; loss of income, medical bills etc.
